3. User Accounts & Responsibilities

• Account Creation: To access the Service, you must create an account and provide accurate, complete information. If you are an administrator creating accounts for others, you are responsible for ensuring you have the necessary consent.
• Account Security: You are responsible for maintaining the confidentiality of your account password and are liable for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• User Conduct: You agree to use the Service only for its intended purpose and in a lawful manner. You will not:
  • Upload or share any illegal, harmful, or inappropriate content.
  • Harass, threaten, or impersonate other users.
  • Interfere with or disrupt the operation of the Service.
  • Attempt to gain unauthorized access to any part of the Service or other user accounts.

4. Billing & Payments

• Pricing: Our pricing is based on a single, all-inclusive plan. Pricing details will be provided to you after a consultation and are subject to the terms of a separate service agreement or invoice.
• Payment Terms: You agree to pay all fees and charges associated with your use of the Service in accordance with the payment terms specified in your agreement.

5. Content & Intellectual Property

• Our Content: All content on the Service, including software, design, text, graphics, and our AI models, is the exclusive property of ExamDeck and its licensors. You may not copy, modify, distribute, or create derivative works from this content without our express written permission.
• User-Generated Content: You retain all ownership rights to any content you create, upload, or submit to the Service ("User Content"), such as notes, assignments, or student projects. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content solely for the purpose of operating and improving the Service.

6. Third-Party Services

The Service may integrate with or link to third-party services (e.g., video conferencing providers, payment gateways, email services). We are not responsible for the terms, conditions, or privacy policies of these third-party services. Your use of such services is at your own risk.

7. Disclaimers & Limitation of Liability

• "As Is" Basis: The Service is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• Limitation of Liability: To the fullest extent permitted by law, ExamDeck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

8. Indemnification

You agree to indemnify and hold harmless ExamDeck and its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses, including legal fees, arising out of or in connection with your use of the Service or your violation of these Terms.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without cause and without notice, if we believe you have violated these Terms. You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.
